Location:                     One-quarter mile west of 9th Street and one-quarter mile north of Kenosha Street at 1111 N. 4th Street

Size of Tract                                          1.20 acres

Number of Lots:                     1

Present Zoning:                     R-1

Proposed Zoning:                     RS-1

Comp Plan:                                          Level 1 (Rural Residential)

BAZ-2003 is a request to change the zoning designation on a 1.20-acre parcel from R-1 (Single-Family Residential) to RS-1 (Single-Family Residential).  The property is platted as Lot 2, Block 1 of Kenwood Acres and is located one-quarter mile west of 9th Street and one-quarter mile north of Kenosha Street at 1111 N. 4th Street.

The applicant is requesting this change in zoning to accommodate the construction of a new home and accessory structure on the property. The rear yard setback for the current R-1 zoning is 20% of the depth of the lot, which makes the setback approximately 60-feet from the rear property line. The applicant is proposing to move the accessory structure closer to the rear property line and is requesting that the zoning on the property be changed to RS-1 to allow a rear yard setback of 25-feet.

60-feet of right-of-way was provided for 4th street with the Kenwood Acres plat. Sidewalks have not been provided along the 4th Street frontage in accordance with the subdivision regulations. According to the FEMA maps, none of the property is located within a 100-year floodplain area.

Surrounding land uses and zoning classifications include the following:

North:                                          R-1                                                                                    One single family residence

East:                                          R-1                                                                                    One single family residence

South:                                          R-1                                                                                    One single family residence

West:                                          R-1                                                                                    One single family residence

The property is designated as Level 1 in the Comprehensive Plan. The RS-1 zoning requested with BAZ-2003 is considered to be in compliance with the Comprehensive Plan in Level 1.

Recommendation:

Based on the Comprehensive Plan, the location of the property, and the surrounding land uses, Staff recommends that BAZ-2003 be approved and that platting be waived, subject to a 4-foot wide sidewalk being constructed, or funds put in escrow, along the frontage of 4th Street when the new structures are constructed.
