Background:
Planned Unit Development (PUD) 243 involves 2.64 acres located on the southeast corner of Kenosha Street and 14th Street, south of Kenosha Street, one-third mile east of 9th Street. In conjunction with PUD 243, BAZ 1946 has been submitted to rezone 1.81 acres of PUD 243 from CH (Commercial Heavy) to IL (Industrial Light). Part of the property has been platted as “Steele-Morrel Center” and part has been platted as “Blocks 1, 2, & 3 Arrow Village Addition.”
Per the applicant, there is a small area between the two plats that is unplatted; therefore they propose to vacate the underlying plats on this property and file a new plat for a proposed new 16,000 square foot automobile collision center. All existing buildings will be removed. An existing off-premise sign is proposed to remain on the property and, according to information provided by the applicant, a 50 year lease exists on this sign from the final date of construction of the sign. The lease can be extended on a year-to-year basis with mutual agreement between the Lessor and the Lessee.
With PUD 243, the property will be divided into two areas, Development Area A and Development Area B. A new automobile collision center is proposed on Development Area A, while the area within Development Area B will be placed on the market for sale. Development Area A, the east part of the property, will be developed in accordance with the IL district, with exceptions as specified in the attached PUD. Development Area B, the west part of the property will be developed in accordance with the CH district, as specified in the attached PUD.
The Planning Commission, in their meeting of November 5, 2015, reviewed and unanimously (4-0 vote) recommended approval of PUD 243 and BAZ 1946, per Staff recommendations. There were several people in the audience. No one protested.
The PUD document reviewed by the Planning Commission stated that the points of access would be spaced in accordance with the zoning ordinance, which is 250 feet apart, centerline to centerline. As engineering plans were being prepared, it was discovered that the proposed access point onto Kenosha Street needs to be located about 225 feet from the centerline of 14th Street to miss some existing infrastructure on Kenosha Street. This will be a new access point; the two existing points of access to Kenosha Street are being closed.

Recommendation: Approve PUD 243 and BAZ 1946 subject to the existing plats on the property being vacated and a new plat being recorded and pursuant to the recommendation of the Planning Commission and Staff, and the following modification made to the PUD design statement:
1. Top of Page 4 - Revise first sentence to say, “The centerline of the access point onto Kenosha Street shall be located at least 225 feet from the centerline of 14th Street.”
