Lot split request BAL 1092 involves a 2.50 acre unplatted parcel located one-half mile south of Florence Street, about one-quarter to one-half mile west of Aspen Avenue.  On April 19, 2016, the City Council approved BAZ 1955 to change the zoning on the property from A-1 to RS-1.  BAZ 1955 was approved subject to six feet of additional street right-of-way and 17.5 feet of utility easement being provided along S. 140th E. Avenue.

 

During the review of the lot split request, it was discovered that the six-inch water line that serves this property comes from the north on the west side of S. 140th E. Avenue.  At the north property line, the water line crosses S. 140th E. Avenue and goes back on S. 140th E. Avenue on the east side all the way back up to Florence Street.  The Utility Department has advised that with the proposed lot split, the south parcel will have to cross the north parcel with a service line.  They have recommended that a five-foot wide easement be provided for the service line and that the service line be located outside the right-of-way and general utility easement.  Staff has also notified the surveyor that a correction needs to be made in the point of commencement.

 

Oklahoma Natural Gas (ONG), Public Service Company of Oklahoma (PSO), Cox Communications, and Windstream have indicated that they do not have any problems with the proposed lot split.

Recommendation:                     

Staff recommends BAL 1092 be approved, subject to the following:  

 

1.                     Warranty deeds for all parcels shall be brought simultaneously to the Planning Division to be stamped prior to being recorded in Tulsa County. 

 

2.                     Right-of-way and utility easements shall be dedicated along S. 140th E. Avenue as per BAZ 1955.

 

3.                     The water service line to serve the south parcel shall be placed in a separate five-foot easement located outside any right-of-way or general utility easements.

 

4.                     Within the legal description of the property, make correction to point of commencement.
