Background:

Upon request of the current property owner, the City of Broken Arrow is proposing to annex approximately 14 acres located on the Southeast corner of 131st Street and 129th East Avenue (Olive), being adjacent to and abutting 131st Street and 129th Street East Avenue (Olive).

Currently this 14 acre tract of land is undeveloped and zoned AG (agriculture) in Tulsa County, Oklahoma.  The proposal is to demolish the current structures on the property, have the property re-zoned to Heavy Commercial (HC) Level 3 and Level 6, and develop a storage facility, convenience store and a single multi-family district.

The Amended Legal Notice of Annexation was previously approved by the City Council at its regular meeting of August 4, 2015.  The Amended Legal Notice of Annexation was published as required by 11 O.S. §21-103, and included the legal description and a map of the area to be annexed at the time of publication.  It was also mailed in accordance with the provisions of Title 11, Section 21-103.  The Amended Legal Notice of Annexation advised all affected property owners within 300 feet of the annexation.

A public hearing will be held prior to the Council’s consideration of this Ordinance.  Staff recommends that the Council adopt Ordinance No. 3363 and approve the Emergency Clause.
