Lot split request BAL 1083 involves a 0.56 acre parcel located one-third mile south of Kenosha Street, one-quarter mile east of Elm Place on the northeast corner of Cedar Avenue and Elgin Street.  The property was platted as part of the Original Town of Broken Arrow with 25-foot wide lots.  Altogether, there are seven existing lots with a depth of 140 feet.  Applicant is requesting to split three of the 140 foot depth lots in half, in effect creating two lots that are 75 feet by 70 feet.  The other four lots will remain as currently platted.  There is an existing residential structure on the property that is proposed to be removed.

 

The property is part of PUD 241 that was approved by the City Council on November 9, 2015.  Applicant is proposing to construct four single-family detached dwelling units on the property.  The property will be developed in accordance with the R-3 development regulations with the following modifications approved with PUD 241:

                     Minimum lot area reduced from 7,000 square feet to 6,125 square feet.

                     Minimum lot frontage reduced from 60 feet to 50 feet.

                     Side yard building setback reduced from 10 feet and 5 feet to 5 feet on each side.

                     Rear yard building setback changed from 20% of lot depth to 15 feet.

 

 

Oklahoma Natural Gas (ONG), Public Service Company of Oklahoma (PSO), Cox Communications, and Windstream have indicated that they do not have any problems with the proposed lot split.

Recommendation:                     

Staff recommends BAL 1083 be approved, subject to the following:  

 

1.                          Warranty deeds for both parcels shall be brought simultaneously to the Planning Division to be stamped prior to being recorded in Tulsa County.
