Approval of and authorization to execute a Public Highway At-Grade Crossing Improvement Agreement between Union Pacific Railroad Company and the City of Broken Arrow

Background:

The Dallas Street Improvements from Elm Place to the alley east of Ash Avenue is a Downtown Street Improvements project approved in the 2008 and 2011 Streets General Obligation Bond election.  The majority of the improvements, repaving the existing 2-lane street, addition or replacement of curbs and gutters, storm drains, and sidewalks, have been completed by the Contractor (Magnum Construction, Inc.).  Work on the Union Pacific Railroad (UPRR) Company property at the intersection of Dallas Street and Cedar Avenue (replacement of the existing 2- and 4-inch water lines with an 8-inch PVC line, sidewalk, and pavement work) has not been completed, as a permit from UPRR for this work was not obtained prior to the start of construction.  Two UPRR permits for the contract work are required - one for the underground water line work and another for the surface work.  A UPRR permit to construct the water line was recently obtained at a cost of $3,005.00.  The remaining sidewalk and pavement work on the UPRR property will be permitted once the attached agreement is executed by UPRR and the City of Broken Arrow (and the Contractor’s Right of Entry Agreement forms are completed by Magnum Construction, Inc.).

Funding for the Dallas Street Improvements construction project is from the 2004 GO Bond and the 2008 Streets GO Bond ($816,060.00).

Cost:                                                                $1,000.00
