Lot split request BAL 1089 involves a 4.83 acre parcel located north and west of the northwest corner of Kenosha Street and Aspen Avenue.  The property, which has been platted as Lot 3, Block 1 of Metropolitan Station II, is part of PUD 179 and has an underlying zoning of CG (Commercial General).  The property is presently undeveloped, but there are four pipelines with their associated easements that pass through it. 

 

Tract 3A, the west parcel, contains 3.55 acres, while Tract 3B, the east parcel, contains 1.28 acres.  According to the applicant, Tract 3B will be joined with Lot 2.  A restaurant is proposed to be located on Lot 2.  They need the area associated with Tract 3B for parking.  No use is presently proposed for Tract 3A.

 

Oklahoma Natural Gas (ONG), Public Service Company of Oklahoma (PSO), Cox Communications, and Windstream have indicated that they do not have any problems with the proposed lot split.

Recommendation:

                     

Staff recommends BAL 1089 be approved, subject to the following:  

 

1.                     Warranty deeds for both parcels shall be brought simultaneously to the Planning Division to be stamped prior to being recorded in Tulsa County.  The warranty deed shall contain a statement acknowledging that Tract 3B shall be permanently attached to Lot 2.
