Background:
The City of Broken Arrow operates a P25 Phase II trunked radio system for both public safety and non-public safety communications. As part of the maintenance of the communications system, each subscriber radio must remain within manufacture and Federal Communications Commission (FCC) specifications. The Locus Diagnostics DiagnostX Over-The-Air Radio analyzer uses over-the-air measurements to identify poorly operating radios or radios that are in nonconformance with FCC requirements or manufacturer’s specifications. This analyzer allows radios to be continually tested each time they make a transmission instead of having the radio removed from service and tested by a technician to verify it is in conformance, resulting in a more efficient method of compliance with FCC requirements.
Section 211 of the E-Government Act of 2002 amended the Federal Property and Administrative Services Act to allow for "Cooperative Purchasing." Cooperative Purchasing allows for the Administrator of General Services to provide states and localities access to certain items offered through the General Services Administration's (GSA's) Federal Supply Schedule 70, Information Technology (IT), and Consolidated (formerly Corporate Contracts) Schedule contracts, containing IT Special Item Numbers (SINs). The information technology available to state and local governments includes automated data processing equipment (including firmware), software, supplies, support equipment, and services.
Section 2-27 of the Broken Arrow Code addresses competitive bidding requirements for supplies, materials, equipment or contractual services. This Section also allows for exemptions to competitive bidding. Subsection (b)(5) provides that competitive bidding is not required for supplies, materials, equipment or contractual services when purchased at a price not exceeding a price set therefore by the state purchasing agency or any other state agency authorized to regulate prices for things purchased by the state or from purchasing consortiums. The GSA is considered to be a consortium and as such, this purchase without bidding is appropriate.
Funding for this purchase is available in the sales tax capital improvement (STCI) fund and is available in savings from other budgeted projects.
