Approval of and authorization to execute a First Amendment to the Professional Services Agreement between the City of Broken Arrow and McAfee & Taft, P.C., for providing counsel and legal advice regarding sovereignty law, employment law and labor law
End
Background:
The City and McAfee & Taft, P.C., entered into an agreement on August 15, 2017 for the firm to provide counsel and legal advice to the City regarding employment and labor issues and sovereignty law related issues. Stephen Bugg with the law firm of McAfee & Taft, P.C., is a well-respected attorney with vast legal knowledge and experience involving sovereignty law. Charlie Plumb is also a well-respected attorney with the law firm of McAfee & Taft, P.C., and has vast legal knowledge and experience involving labor and employment law.
The attached First Amendment to the Professional Services Agreement is requested to change Section V, Fees and Expenses, to increase the maximum fees, costs, and expenses cap from $100,000.00 to $150,000.00. The First Amendment memorializes continued retention of the firm, costs and the hourly rates to be charged. The firm charges the following rates:
Employment/Labor Law Sovereignty Law
Shareholders: $305.00 per hr maximum $305.00 per hr maximum
Associates: $205.00 per hr maximum $215.00 per hr maximum
Paralegals: $105.00 per hr maximum $95.00 per hr maximum
Arbitration $250.00 per hour maximum N/A
Staff recommends that the Council approve the Frist Amendment and authorize its execution.
Cost: Not to exceed $150,000.00.
