Background:

BAZ-002875-2026 is a request to change the zoning designation on 1.89 acres from IL (Industrial Light) to CH (Commercial Heavy). The property is located one-eighth mile south of Houston Street (81st Street), east of 9th Street (177th E. Avenue/Lynn Lane Road) and is platted as Lots 4 and 5, Block 1, Lynn Lane Plaza East.

This property was developed as a multi-tenant office warehouse facility with IL zoning. The applicant is requesting to rezone the lot to CH in order to accommodate additional uses, such as general personal services and fitness and recreation sports centers. Office warehouses are also a permitted use by right in CH zoning, so the change in zoning will not affect existing or future office warehouse tenants. This property meets all of the dimensional standards for the CH zoning district. Planning Commission expressed concerns with the increased parking requirements that would accompany the change in use. The applicant stated they were aware of the parking requirements and development would be limited by the amount of parking currently available.

 

This property is designated as Level 6 in the Comprehensive Plan and requested CH zoning is in accordance with that designation.

 

During the meeting held June 25, 2026, the Planning Commission recommended approval (5-0) of BAZ-002875-2026 per Staff recommendation. Staff recommended approval, and that platting be waived since the property is already platted. During the public comment period staff read an emailed public comment expressing concerns with the availability of parking.
