Planned Unit Development (PUD) 239 involves 13.04 acres located one-quarter mile south of the southeast corner of Jasper Street and Garnett Road.  On July 21, 2015, the City Council conditionally approved PUD 239 and BAZ 1940, a request to change the underlying zoning from A-1 to RS-2.  Both PUD 239 and BAZ 1940 were approved subject to the property being platted and as per the PUD Design Statement submitted to the City Council on June 25, 2015. 

 

The design statement submitted by the applicant to the City Council stated “Private street right-of-way shall not be less than 30 feet in width and shall be located within a reserve area to be owned and maintained by the homeowners association.”  The design statement also stated that the minimum lot size would be 25,100 square feet.  This square footage, however, did not accommodate any reserve area for the private street.  With PUD 239A, applicant is requesting that the minimum lot size be changed from 25,100 square feet to 21, 700 to reflect the lot area being placed into the private reserve.  This is the only change being requested to PUD 239.

According to the FEMA maps, none of the property is located in a 100-year floodplain area.  The 100-year floodplain of the Arkansas River, however, is located just to the south of this property.

Recommendation:                      

Based on the Comprehensive Plan, the location of the property, and the surrounding land uses, Staff recommends that PUD 239A be approved as presented, subject to the property being platted.
