BAZ-2004 is a request to change the zoning designation on a 7.50-acre tract from A-1 (Agricultural) to RS-3 (Single-Family Residential).  The unplatted property is located one-half mile north of Houston Street, west of Evans Road.  The A-1 zoning was assigned to the property when it was annexed into the City Limits on June 2, 1980, with Ordinance 833.  There is an existing single family house on the northeast part of the property.  The west half of the property is undeveloped.

 

Applicant is interested in splitting their property into two lots.  The existing parcel meets the minimum lot size and lot frontage requirements of the A-1 district.  However, the lots proposed with the lot split do not meet the minimum lot size and frontage requirements.  Therefore, before the lot split can be addressed, the zoning on the property needs to be modified.

 

Along the south end of the property, there is a 60-foot wide strip that has a private roadway easement associated with it.  This property was recently acquired by the applicant.  With this acquisition, both parcels associated with the proposed lot split will have frontage onto public street (i.e. Evans Road).  In addition, both properties will meet the minimum lot frontage requirement of the RS-3 district of 60 feet.

 

According to the FEMA maps, none of the subject property is located in the 100-year floodplain.

Recommendation:                      

Based on the Comprehensive Plan, the location of the property, and the surrounding land uses, Staff recommends that BAZ 2004 be approved.  The Zoning Ordinance requires any changes in zoning to be approved subject to platting.  Staff recommends that platting be waived, provided right-of-way is dedicated along Evans Road in accordance with the Subdivision Regulations, which is 50 feet from the section line and 17.5 feet of utility easement is provided adjacent to the right-of-way line.
