Background:

On April 19, 2016, the City Council approved BAZ 1955, a request to change the zoning on 2.5 acres from A-1 (Agricultural) to RS-1 (Single-Family Residential).  The property is located one-half mile south of Florence Street, one-quarter to one-half mile west of Aspen Avenue.  BAZ 1955 was approved subject to six feet of right-of-way and 17.5 feet of utility easement being dedicated on the west side of South 140th East Avenue.

 

At the April 28, 2016, Planning Commission meeting, BAL 1092, a request for a lot split on the same property associated with BAZ 1955, was approved subject to right-of-way and utility easements being provided along the west side of South 140th East Avenue.  The applicant/owner Steven and Robyn Paliotta have submitted an application requesting the acceptance of a 17.5-foot Utility Easement along the west side of S. 140th East Avenue as stipulated with the approval of BAZ 1955 and BAL 1092.

 

Staff has reviewed the documents and recommends that the Council accept the Utility Easement.
