Background:

BAZ-002826-2026 is a rezoning request proposing to change the zoning on this property from A-1 (Agriculture) to RS-P (Single-Family Residential- Preservation) for the purpose of a single-family residential subdivision.

 

The Comprehensive Plan map reflects approximately 2.07 of the 39.18 acres of the parcel designated for Level 6 (Regional Employment/Commercial) with the remaining 37.11 acres designated for Level 2 (Urban Residential). Under the Implementation Policies of the Comprehensive Plan, Policy 17 states, “A ten percent (10%) variance or adjustment in the gross area of specific LUIS level designations, however, shall be allowed to accommodate errors in surveying or computerization of the INCOG parcel base mapping upon which the Future Development Guide was created. In no case, however, shall this adjustment be allowed to increase or decrease the gross area of the LUIS designation by more than 10%. Adjustments of overall gross area by more than 10% shall only be made after receipt of an amendment to the Future Development Guide as outlined herein.” Based on this provision, the 2.07 acres is under the 10% threshold (3.918 acres).

This request was heard before Planning Commission at their regular meeting of June 11, 2026, where public concerns around 40-foot-wide versus 60-foot-wide lots, floodplain, and water being diverted from a pond on the east side of 23rd Street. The applicant stated that with the 40-foot-wide lots in RS-P zoning, 25 percent of the site is required to be open space, providing approximately 10 acres of open/greenspace and equating to 5.89 dwelling units per acre (DU/AC). The 60-foot-wide lots would be RS zoning; however, no open space is required with this zoning, resulting in 6.7 DU/AC. The RS zoning would have a higher density than the proposed RS-P. Staff confirmed there is no floodplain on the property, and that the applicant would be required to adhere to all the stormwater regulations of the City of Broken Arrow.

 

A motion was made to recommend approval of the rezoning but failed due to lack of a second. A motion was made to recommend denial and passed with a 3-1 vote with some commissioners expressing concern about the smaller proposed lot sizes. The applicant provided a written request within the 15-day timeframe for this rezoning application to be heard by City Council.
