Background:

On April 18, 2023, pursuant to the provision of 11 O.S. § 42-110, the City of Broken Arrow adopted Ordinance No. 3782 closing a Temporary Storm Sewer easement located on property located one-quarter mile north of Florence Street (111th East Avenue), east of Olive Avenue (129th East Avenue), Tulsa County, State of Oklahoma (Section 28, T18N, R14E). The easement is more particularly described as follows:

A TRACT OF LAND SITUATED IN THE NORTHEAST QUARTER (NE/4) OF SECTION TWENTY-EIGHT, TOWNSHIP EIGHTEEN NORTH, RANGE FOURTEEN EAST OF THE INDIAN BASE AND MERIDIAN, CITY OF BROKEN ARROW, TULSA COUNTY, STATE OF OKLAHOMA, ACCORDING TO THE UNITED STATES GOVERNMENT SURVEY THEREOF, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:

On June 27, 2023, the current owner of the subject property filed suit to foreclose the right to reopen a Temporary Storm Sewer easement. There is no necessity for reopening Temporary Storm Sewer easement and the easement is no longer required for public purposes. Furthermore, no public convenience or necessity exists for the reopening of the Temporary Storm Sewer easement and the foreclosure of the right to reopen the Temporary Storm Sewer easement will not injuriously affect the rights of the owners of the property in the vicinity of the easement.

 

Accordingly, as a result of the foregoing, Legal recommends approval to enter into a Final Journal Entry of Judgment foreclosing the above described utility easement that was closed by Ordinance No. 3782 enacted by the City Council on April 18, 2023.
