Background:
The Broken Arrow City Council first considered BAZ 1941 on September 1, 2015, and continued it to their first meeting of November 2015. The City Council requested additional information regarding the storm water drainage system in this area, along with the proposed and improved design layout of the subdivision, as well as the traffic and road conditions along Midway Road. On November 9, 2015, Staff presented the additional information requested by the City Council. At the November 9, 2015 meeting, at the request of the applicant, the City Council continued BAZ 1941 indefinitely. During both City Council hearings there were several protestants present.
On December 29, 2015, Staff received a letter from the applicant requesting BAZ 1941 be placed on the February 2, 2016, agenda. In conjunction with this request, new notices were sent to all property owners within 300 feet, new signs advertising the date and time of the meeting were posted, and a legal notice was placed in the newspaper.
BAZ 1941 is a request to change the zoning designation on an 80.00 acre tract from A-1 (Agricultural) to RS-3 (Single-Family Residential). The undeveloped property is located east of Midway Road, one-quarter mile north of Kenosha Street. According to the latest draft preliminary plat, applicant is proposing to develop a single-family detached subdivision with 231 lots.
According to FEMA maps, none of the property is located within a 100-year floodplain. However, there is a drainage swale that passes through the property.
Ridgeway Heights abuts this 80 acre property associated with BAZ 1941 to the south. There are no stub streets along the north boundary of Ridgeway Heights that would allow connectivity between the two neighborhoods.
The Planning Commission reviewed this rezoning request on August 13, 2015, and recommended (4-1 vote) approval of RS-3 zoning. During the Planning Commission hearing, there were more than 30 protestants present and about 7 persons spoke against the proposal.
