Lot split request BAL-2039 involves a 2.11-acre parcel located north of the northeast corner of Kenosha Street and Aspen Avenue.  The property is platted as Lot 2, Block 1, Dental Depot Broken Arrow. 

 

Applicant is proposing to split the property into two new lots. The north lot, Tract A, will consist of 0.82 acres and has been developed as Dunkin Donuts. The south lot, Tract B, will consist of 1.26 acres and remains undeveloped. In conjunction with this lot split request, the applicant has submitted a request to modify the minimum lot size and lot frontage of Development Area B of PUD-223. If PUD-223A is approved, both tracts will meet the lot frontage and size requirements of the PUD and the CN zoning district.

 

According to the FEMA maps, none of the property is located within a 100-year floodplain area.  

 

Oklahoma Natural Gas (ONG), Public Service Company of Oklahoma (PSO), Cox Communications, and Windstream have indicated that they do not have any problems with the proposed lot split and lot consolidation.

Recommendation:                     

 

Staff recommends BAL-2039 be approved, subject to the following:

 

1.                      The approval of PUD-223A by the Planning Commission.

2.                     Warranty deeds for both parcels being simultaneously brought to the Planning Division to be stamped before being recorded in Tulsa County.
