Background:
The City of Broken Arrow and the Broken Arrow Municipal Authority require specialized outside legal counsel in connection with an existing conflict and potential litigation involving Rural Water District No. 5, Wagoner County.
On July 24, 2026, Hall Estill transmitted an Engagement Letter (attached) confirming the firm’s willingness to provide professional legal services under the firm’s Standard Terms of Engagement for Legal Services (also attached). Bryan J. Nowlin will serve as the primary Relationship Attorney.
The Engagement Letter sets the following discounted hourly rates for the attorneys expected to work on the matter:
Bryan J. Nowlin $395.00 per hour maximum
Logan L. James $300.00 per hour maximum
Connor M. Andreen $240.00 per hour maximum
Zachary W. Brewer $190.00 per hour maximum
Fees are based on actual time expended (recorded in tenths or quarters of an hour) and are not contingent. Payment is due within 30 days of invoice. The representation is limited to the matters described in the Engagement Letter; any expansion of scope would require additional written authorization.
This engagement is consistent with prior City and Authority practice of retaining specialized outside counsel for complex or specialized matters (e.g., workers’ compensation outside counsel agreements previously approved by Council). The City Attorney’s Office has reviewed the Engagement Letter and Standard Terms and finds them acceptable under applicable Oklahoma law and the City’s procurement and legal-services practices.
Routine costs such as copying and postage are addressed in the Agreement. Costs and fees for this matter will be paid by the City as incurred.
