Planned Unit Development (PUD) 66E is a request for a minor amendment to PUD 66 to reduce the rear building setback line next to Houston Street from 35 feet to 25 feet.  A new single family residence is under construction on the property.  Applicant wants to add a covered patio to the rear of the property.  While the rest of the structure is in compliance with the setback requirements, the brick columns supporting the roof for the patio covering are located 9 feet 6 inches into the building line setback.  As a result, applicant is requesting that the rear building line setback be reduced from 35 feet to 25 feet.  According to the applicant, the Forest Ridge homeowners association and The Cottages at Forest Creek homeowners association have acknowledged they are in agreement with the proposed request.

 

PUD 66, which encompassed 660 acres, was approved by the City Council on August 2, 1988.  Since the approval of PUD 66, there have been three major amendments and one minor amendment to the PUD.

The property is designated as Level 2 in the Comprehensive Plan.  The change in the rear building line setback for the porch covering proposed with PUD 66E is considered to be in compliance with the Comprehensive Plan in Level 2.

Recommendation:                      

Based on the Comprehensive Plan, the location of the property, and the surrounding land uses, Staff recommends that PUD 66E be approved as presented.  Since the property is currently platted, Staff recommends that platting be waived.
