Background:

The owner, Mr. Phil Roland of Roland Investments, Ltd, has executed a Special Warranty Deed granting all interests in a specific parcel of land to the City of Broken Arrow.  This parcel consists of the area of the creek located immediately west of the proposed Stoney Creek Hotel and Convention Center site. This area is currently identified as a blue line stream and conveys storm water runoff from the First Baptist Church detention pond located immediately off-site to the north of the property, as well as stormwater from the majority of the Stoney Creek development, the vacant Roland Investment tract of land to the west of the creek and a portion of the Hilton Garden Inn development currently under construction. The City has a stormwater management plan for the creek in this location. The idea is to better incorporate this creek and the potential water feature into the Hotel and Convention Center site as a part of its design.

Staff has reviewed the Special Warranty Deed and recommends that the Council accept it.
