PT21-121, the conditional final plat for The Learning Experience, contains a single 5.16-acre lot. This property is located one-quarter mile south of Omaha Street (51st Street), east of 9th Street (177th E. Avenue/Lynn Lane Road), north of Nienhuis Park. The parcel, which has 199.97 feet of frontage onto 9th Street, is split by a 100-year floodplain associated with Adams Creek.
BAZ 1966, a request to rezone the property from A-1(Agricultural) to ON (Office Neighborhood) was reviewed and approved by the City Council on December 20, 2016, subject to the property being platted. The applicant associated with BAZ-1966 was interested in developing an event center on the property, which by the Zoning Ordinance is classified as a “Place of Assembly”. “Place of Assembly” is a permitted use in the ON district. The presently proposed plat is for The Learning Experience, a childhood development center, which is also a permitted use in the ON district. Recording of this plat would satisfy the condition of platting to rezone the property from A-1 to ON via BAZ-1966.
In the Staff report for BAZ-1966, it was noted that the access point onto 9th Street would need to be located near the northwest corner of the property, the centerline of which was to be at least 250 feet from the centerline of the access point into Nienhuis Park. This conditional final plat reflects that separation.
Planned Unit Development (PUD)-335 was submitted at the same time as the preliminary plat for The Learning Experience but has since been withdrawn as the conditional final plat proposes only one lot instead of two. The primary reason for the PUD application was to request that the second lot have no frontage onto a public street and that it would instead gain access from Nienhuis Park. Without a second lot that is no longer necessary.
The property associated with this plat had also previously been approved by the City Council on March 2, 1998, as part of PUD-110 and BAZ-1340. PUD-110 was a 199-acre development referred to as the “Broken Arrow Golf and Athletic Club”. The PUD divided the property into four tracts. Tract 1, which represents the same area associated with The Learning Experience plat, was proposed as a single family detached residential area with up to eight dwelling units that was to be developed in accordance with the R-1 Single Family Detached development regulations. While the rest of the PUD was developed with multifamily units and a golf course, Tract 1 was never platted or developed. The development regulations of PUD-110 on Tract 1 were abrogated when BAZ-1966 was approved by the City Council.
According to FEMA maps, the central part of the property is in the 100-year floodplain of Adams Creek. Water and sanitary sewer will be provided by the City of Broken Arrow.
This item was heard by TAC on May 3, 2022. It was recommended for approval (4-0 vote) by the Planning Commission in their meeting of May 26, 2022, per Staff and the Technical Advisory Committee recommendation.
