title
Consideration, discussion and possible adoption of Ordinance No. 3306-Corrected, an ordinance amending the Zoning Ordinance of the City of Broken Arrow, Oklahoma, approving BAZ 1878, granting PUD 217 and Residential Multi-Family zoning classification be placed upon the tracts, repealing all ordinances or parts of ordinances in conflict herewith, and declaring an emergency
End
Background:
The City of Broken Arrow contracts with the Tulsa Business and Legal News and the Wagoner Tribune to meet its statutory requirements for legal notices and publications in Tulsa and Wagoner County. Recently, the Tulsa World purchased the Tulsa Business and Legal News, the Wagoner Tribune and the Broken Arrow Ledger. During the acquisition and reorganization process, several items sent for publication to the Tulsa Business and Legal News were inadvertently omitted. This resulted in publication in the Wagoner Tribune, but not the Tulsa Business Legal News.
State statute requires that before an Ordinance can become legally effective, it must first be published in a newspaper of general circulation within fifteen (15) days after its adoption by the governing body. The attached corrected ordinance is being submitted to the City Council for adoption so that all legal publication requirements will be met.
Council Members may recall that rezoning case BAZ 1878 (A-1 to RM) and PUD 217 were approved by the Broken Arrow City Council on July 17, 2012, subject to the property being platted. The property is located east of 23rd Street, one-quarter mile north of Albany Street. On December 13, 2013, the plat “The Park at Albany” was recorded in Wagoner County.
