Approval of and authorization to execute procurement contract with Contech Engineered Solutions, LLC, for 80’ prefabricated bridge for the Wolf Creek Pedestrian Bridge Improvement (Project Number 2653250)

Background:
The existing pedestrian bridge at Wolf Creek Park was closed due to structural safety concerns. With the closure, school children and residents are currently required to use a significantly longer detour route that presents both inconvenience and public safety risks. Due to these conditions, staff determined that replacement of the bridge must be expedited to protect public welfare.
City staff engaged a design consultant to produce contract documents for a replacement structure. While the consultant successfully completed the design, subsequent inquiries revealed that the proposed bridge configuration would require a minimum six month fabrication timeframe. Given the urgency of restoring safe pedestrian access across the creek, this timeline was not feasible.
Alternative procurement options were explored, identifying a prefabricated pedestrian bridge available from Contech. The consultant verified that the Contech bridge meets all hydraulic, structural, and geometric requirements for the project site.
Additionally, staff consulted with the City’s Legal Department to determine whether a sole-source purchase would be permissible. Legal staff confirmed that a sole-source procurement is supportable under Section 2 27(b)(2) of the Broken Arrow Code because:
This particular bridge has already been manufactured and is owned or controlled by Contech; Contech is the only source from which this specific inventory bridge can be purchased; The City’s consultant has determined that the bridge will work at the project location and has redesigned the project around it; Procuring a newly fabricated bridge from another manufacturer would materially delay reopening the pedestrian connection; and The delay affects residents and schoolchildren who previously used the bridge.
Given these factors, staff recommends approval of the Contech Quote and Addendum for procurement of the prefabricated pedestrian bridge.
