Consideration, discussion and possible approval of and authorization to execute Resolution No. 1616, a Resolution of the Broken Arrow City Council declaring an emergency as a result of the November 2024 rain storms and damage to city infrastructure including the bridge carrying New Orleans Street over Haikey Creek in the City of Broken Arrow; Activation of the City’s emergency operation protocols, including waiving state and local provisions pertaining to competitive bidding as allowed by law; authorizing an informal bidding process; Awarding the of the lowest responsible quote for bridge repairs to Timber Wolf Excavating, Inc.; Authorizing the City Manager to execute emergency contracts as necessary for repairs and any subsequent critical events; Providing for the termination and extension of the provisions of this resolution; and directing the City Manager to carry out all applicable provisions

Background:
On November 22, 2024, City staff inspecting the construction of waterline under the “Florence and Haikey Creek Sewer and Waterline Rehabilitation” project observed a large amount of debris under the bridge that carries New Orleans Street over Haikey Creek. Upon further inspection, the west abutment was noted to have significant scour under the pile cap which was exposing the steel H-piles that support he bridge abutment. Garver, the consultant that performed bridge inspections throughout the City of Broken Arrow in 2022, was engaged to perform an emergency evaluation of the bridge. Garver field inspector arrived at the bridge the afternoon of November 22, 2024, and City staff received the professional evaluation from Garver engineering staff.
The evaluation determined that the excessive debris diverted stormwater flow in the creek towards the western abutment of the bridge. City staff believes that the debris/drift was carried by heavy rain events from November 3, 2024, to November 9, 2024 that totaled nearly ten (10) inches of rain. Garver provided recommendations to remedy the bridge including: regular monitoring of the bridge, clearing the debris/drift, cleaning and encasing the exposed steel piles under the abutment, regrading the slopes around the abutment, and placement of riprap to armor the abutment slopes. It was also recommended to initiate repairs within two (2) weeks of November, 2024 in order to avoid critical findings and/or closure of the bridge. Streets and Stormwater department staff has and will continue to monitor the bridge for future deterioration and damage to ensure the safety of the public. Staff contacted three (3) reputable contractors that have capacity to preform the repairs. The lowest responsible quote for the prescribed repairs came from Timber Wolf Excavating, Inc. at a value of $109,650.
The heavy rains constitute a natural emergency as defined in Section 9-1 of the Broken Arrow Code justifying adoption of a Resolution to such effect. Immediate attention is required and continues to be required to protect the public health, safety and welfare, ensure public safety and provide for the worst-case scenario.
During this period of declared emergency, it is necessary and prudent that the City Manager be able to take action and implement policies quickly and expeditiously in the best interest of the residents of the City of Broken Arrow. The current procedures set forth in the Public Competitive Bidding Act codified in 61 O.S. § 101, et seq., and § 2-27 of the Broken Arrow Code will take in excess of sixty (60) days. It is estimated that the savings that would occur as a result of the competitive bidding process would not be sufficient to justify the potential danger to the safety of the public. It is necessary that the City Manager be able to enter into contracts quickly and expeditiously during this time of declared emergency, in order to serve the residents of Broken Arrow. It is further necessary that during this period of declared emergency, it is necessary and prudent that the City Manager be able to take action and implement policies quickly and expeditiously in the best interest of the residents of the City of Broken Arrow. The provisions of Resolution 1616 shall expire forty-five (45) days from this date.
