Lot split request BAL 2006 involves a 2.59-acre parcel located one-quarter mile west of 23rd Street, one-half mile north of New Orleans Street.  The property, which is zoned RE, is unplatted and has an existing single-family structure.  The zoning designation on the property changed from A-RE to RE with BAZ 1963 that was approved by the City Council on October 4, 2016. 

 

Applicant is proposing to split the lot into two parcels, Tracts B and C.  Tract B, the east parcel, contains 0.56 acres; Tract C, the west parcel, has 2.03 acres.  There is an existing single-family home on Tract B.  The other tract is undeveloped.  The proposed lot split meets the minimum lot size, frontage, and setback requirements of the RE district.  BOA 719, a request to reduce the setback requirement from 15 feet to 14 feet for the existing structure from the existing east property line is going to the Board of Adjustment on December 12, 2016.  The proposed lot split has no impact on the Board of Adjustment request.

 

It is the policy of the City of Broken Arrow that when property is within 300 feet of sanitary sewer, the structure shall connect onto the sanitary sewer line.  Tract C abuts the Seven Oaks subdivision to the south.  There is an existing sanitary sewer line in Seven Oaks that should be available to serve Tract C. 

The existing structure on Tract B is on a septic system. The survey drawing submitted by the applicant does not show the lateral fields associated with the septic tank.  This information is needed to confirm that the lateral field do not cross property lines.

 

Oklahoma Natural Gas (ONG), Public Service Company of Oklahoma (PSO), Cox Communications, and Windstream have indicated that they do not have any problems with the proposed lot split.

Recommendation:                     

 

Staff recommends BAL 2006 be approved, subject to the following:

1.                     Warranty deeds for both parcels shall be brought simultaneously to the Planning Division to be stamped prior to being recorded in Tulsa County;

2.                     Any new structures constructed on Tract C that require sanitary sewer service shall be connected to the sanitary sewer line in the Seven Oaks addition, unless there are topographical constraints that prevent the connection to the sanitary sewer line.

3.                     Prior to the warranty deeds being stamped, the surveyor shall provide written verification that all lateral lines associated with the septic tank on Tract B are located on the property and do not cross any property lines.
