Background:

 

BACP 145 is a request to change the Comprehensive Plan designation from Level 2 to Level 5 and BAZ 1938 is a request to change the zoning on this property from R-3 to DM. This vacant property consists of 0.40 acres and is being used as a staging area for construction equipment and materials for The District at 222 loft apartment, under construction to the east. This property is located on the southwest corner of Ash Avenue and Commercial Street.

 

According to the application, this request is to construct an asphalt parking lot that will serve the residents of The District at 222 loft apartments, as well as patrons of the Rose District. In conjunction with the  parking  lot,  seven  on-street parking  spaces  will  be  constructed  along  Commercial  Street. Per Section 5.2.B.1.b, of the  Zoning  Ordinance, landscaping/decorative  walls  or  fencing  is required  along  Ash  Avenue  and  Commercial  Street and, per Section 5.2.B.1.d, landscaping is required along the west boundary next to the residential property.

 

A 28-inch caliper Catalpa tree abuts the northeast corner of this property and is historically significant to the City of Broken Arrow as it was one of the first trees brought by the settlers of Broken Arrow. The grading plan notes the historical significance of this tree and contractors have been informed not to disturb the tree and to use extreme caution when working in the area around the tree.

 

On May 12, 2015, BACP 146 and BAZ 1938 were reviewed by the Downtown Advisory Board (DAB) and recommended for approval with modifications to the conditions recommended by Staff. The Planning Commission, in their meeting of June 25, 2015, reviewed and unanimously (4-0 vote) recommended conditional approval of BACP 146 and BAZ 1938, as submitted in the revised site plan received June 8, 2015, subject to conditions set forth for lighting, fencing and protecting the historic tree.

Recommendation:

 

Approve BACP 145 and BAZ 1938 be approved subject to the recommendations of Staff, the Planning Commission and the following:

 

1.                     The historic tree, located on the northeast corner of the property, be protected and, as noted on the grading plans, shall not be disturbed.  Extreme caution shall be used when working in this area.  

 

2.                     Landscaping and fencing shall be provided in accordance with Sections 5.2.B.1.b and 5.2.B.1.d of the Zoning Ordinance. On portions of the west perimeter there will be an 8 feet high opaque fence. The existing wood picket fence, placed by the adjoining residential property shall remain (as requested by that property owner), and placement of a wrought iron fence on the south boundary.

 

3.                     Parking lot lighting (underground) conduits will be installed and lighting will be installed at a later date, in accordance to the Zoning Ordinance and required photometric drawing.
