Lot split request BAL 1093 involves a 13.01-acre undeveloped parcel located on the southwest corner of New Orleans Street and Aspen Avenue.  The property was zoned CN and CG as part of BAZ 609 that was approved by the City Council in August 1977. 

 

Applicant is proposing to split the property into two equal tracts.  A new library is proposed to be constructed on the west tract, and the east tract will be left for commercial development.

 

The property has not been platted.   According to the information provided by the applicant, right-of-way has been dedicated along Aspen Avenue in accordance with the Subdivision Regulations, but not along New Orleans Street.  In addition, utility easements have not been dedicated along both New Orleans Street and Aspen Avenue per the Subdivision Regulations.

 

Oklahoma Natural Gas (ONG), Public Service Company of Oklahoma (PSO), Cox Communications, and Windstream have indicated they do not have any problems with the proposed lot split.

Recommendation:                     

Staff recommends BAL 1093 be approved, subject to the following:  

 

1.                      Warranty deeds for both parcels shall be brought simultaneously to the Planning Division to be stamped prior to recordation in Tulsa County.

 

2.                      Right-of-way shall be dedicated in accordance with the Subdivision Regulations along New Orleans Street between Aspen Avenue and Chestnut Avenue (65 feet of right-of-way from the section line, for 350 feet from the point of intersection with Aspen Avenue transitioning back at a 30-degree angle to 60 feet).  In addition, 17.5 feet of utility easement shall be dedicated along the entire frontage along New Orleans Street and Aspen Avenue.  Right-of-way and utility easements shall be submitted to and approved by the City of Broken Arrow prior to the warranty deeds being stamped.
