Approval of Worker’s Compensation Court Order for Daniel Haas, Fire Department Employee

End

Background:

The City received an Oklahoma Workers’ Compensation Court Order for Daniel Haas, Fire Department.  The court order is presented for the City Council’s approval.

Mr. Haas injured his lower back on January 30, 2014 while assisting a patient out of the ambulance into the hospital.

The court found Mr. Haas sustained a 10% permanent partial impairment to the lower back and determined that he is entitled to compensation totaling $16,150.00.  This amount may be reduced if the court determines that Mr. Haas earned wages while earning temporary total disability compensation.  The City’s Workers’ Compensation attorney advises that this will be determined at a hearing scheduled on November 9, 2015.

The sum of $3,230.00 must be deducted from the award and paid to his attorney, Esther Sanders.  A credit of $5,723.71 for overpayment of temporary total disability compensation will also be deducted from the award.

The order directs the City to pay taxes in the sum of $444.13 and a filing fee in the sum of $140.00 in which the amounts will be on the payment list for council approval.

The City’s Workers’ Compensation Attorney advises that there is no basis for appeal and would recommend the order by placed in line for payment.

Cost:                                                                $11,010.42 unless reduced by the court on November 9, 2015
