Background:

At the request of the property owner, the City of Broken Arrow is proposing to annex 1.15 acres generally located West of Oneta Road and North of State Highway 51.  The purpose of the annexation is the development of Kum and Go Store No. 837.

Pursuant to Title 11, Section 21-103 of the Oklahoma Statutes, the Council must direct publication in a legally qualified newspaper of general circulation within fourteen (14) days of approval of the Notice.  State Statute also requires that Notice be sent to all owners of property abutting any public right-of-way that forms the boundary of the territory proposed to be annexed.  Staff recommends that the Council approve the Legal Notice of Annexation and direct its publication and mailing in accordance with the provisions of State Statutes.
