Background:

COMP-001693-2024 is a request to change the Comprehensive Plan designation from Level 6 to Level 3 on approximately 40.2 acres which is currently unplatted. The property is located west of 23rd Street and north of Washington Street.

 

The applicant is requesting this change to the comprehensive plan for the purpose of a potential residential subdivision. In preparation for the possible approval of this amendment to the comprehensive plan, the applicant has also submitted a rezoning request BAZ-001692-2024 to change the zoning to RS-4. The applicant has submitted a preliminary plat showing a conceptual layout for the development. The preliminary plat shows several phases of this project, the area concerned with this request is the northern most section identified as Phase V, in purple.

 

Amending the Comprehensive Plan to Level 3 could potentially support a future rezoning to the zoning districts identified as possible or allowed within the Comprehensive Plan Table 4-1: Land Use Intensity System Zoning District Table.

 

This item was heard by Planning Commission on September 26, 2024, and was approved with a 3-1 vote per Staff recommendation. Staff recommended to approve COMP-001693-2024, subject to the property being platted. No one spoke on this item.

 

At the City Council meeting held October 15, 2024, this item was continued to the November 19 2024, meeting to allow Staff and the applicant to address questions presented by Council Members.

 

City Council asked for information regarding sanitary sewer capacity in the area due to the problems identified on the east side of County Line Road (23rd Street) for a different development. The Planning & Development division and Engineering/Construction team met with the applicant on Monday, October 21, 2024, to understand any potential issues. It was clarified at this meeting that the sanitary sewer challenges that exist to the north and east of this property do not exist on the west side of County Line Road. The west side of County Line Road is served by a 24-inch trunk sewer line that extends along the west side of the road and has capacity to serve this proposed development.

 

Questions were raised regarding traffic created by the proposed development and the status of road improvements in the area. This development is to be served by two driveway entrances onto Washington Street (91st Street) to the south, as well as internal connections between existing neighborhoods. The final phase of this development will provide a connection to the existing Nashville Street to the north. Nashville Street currently serves industrial areas however, residential traffic may travel through industrial areas, while industrial traffic may not travel through residential areas. Due to the floodplain to the east of the subject tract, no direct access onto County Line Road is possible at this time.  

 

Engineering and Construction is in the process of starting design work on the intersection of Washington and County Line Road. There is no specific timeline for construction of the improvements. The interior of mile of County Line Road between Houston and Washington has not been identified as an upcoming project. A road widening project on Washington Street between Lynn Lane and County Line Road is currently in design and is expected to start construction in April of 2025. A road widening project on Lynn Lane, between Houston and Washington is also under design and expected to start construction in August of 2025.
