Background:

At the request of the property owner, the City of Broken Arrow has been requested to annex approximately 75.48 acres located one-third mile north of Washington Street (91st Street), west of Oneta Road (241st E. Avenue), Section 16, Township 18 North, Range 15 East, Wagoner County, State of Oklahoma.

Pursuant to 11 O.S. § 21-103, the City Council must direct publication of a Notice of Annexation in a legally qualified newspaper of general circulation in the territory. The notice must be published within fourteen (14) days following the date the City Council directs publication. Copies of the notice and the required annexation materials must also be mailed to those persons and entities entitled to notice under state law. The public hearing must be held no earlier than fourteen (14) days nor more than thirty (30) days following both publication and mailing of the notice. The proposed Municipal Services Extension Plan must be included with the published and mailed notices and made available for inspection prior to the public hearing. To accommodate these requirements, all notices shall be sent by certified mail.

These approximately 75.48 acres contain one (1) parcel, which is currently used for a single-family residence. The property is projected to be developed for a single-family residential subdivision.

To begin the process of adding this property to the City Limits of Broken Arrow, Staff is requesting that the City Council approve the publication of the notice with the attached legal description. This request was initially on the August 18, 2026, City Council agenda and on the September 1, 2026, agenda. Due to the limited publication of the local newspaper in Wagoner County, additional time was needed to meet the statutory noticing requirements. Now that all the required documents are available, this item is returning to the Council to request that the City Council direct the City Clerk to publish the Legal Notice of Annexation.
