Background:
COMP-001531-2024 was on the Planning Commission agenda on June 27th, 2024, and August 8th meeting, where approval was recommended to City Council. This comprehensive plan change is a proposal to change the Comprehensive Plan designation from Level 2 (Urban Residential) and Level 3 (Transitional Area) to Level 3. COMP-001531-2024 was heard by City Council on August 20th, 2024.
BAZ-001624-2024 (Rezoning) and PUD-001623-2024 (Planned Unit Development) was a request to change the zoning on the 10.9 acre property from A-1 and R-2 to CM/PUD-001623-2024. located one-quarter mile north of Kenosha Street and one-quarter mile east of North Elm Place. The property is currently un-platted and undeveloped. Planning Commission approved the rezoning application on August 22, 2024. City Council approved the rezoning and PUD applications on September 3, 2024.
PT-002295-2025, the preliminary plat for Ven Park, contains 71 lots on 10.90 acres. This property is generally located one-quarter mile north of Kenosha Street (East 71st Street South) and one-quarter mile east of North Elm Place (North 161st East Avenue). The property is currently unplatted. Planning Commission approved PT-002295-2025 on August 14, 2025.
The Development Agreement establishes the framework for certain public infrastructure improvements associated with the Ven Park development. Specifically, the agreement addresses roadway connectivity and related transportation improvements necessary to provide access to the Ven Park development site from West Madison Street and North Birch Avenue. These improvements are intended to establish appropriate vehicular connectivity between the existing and proposed public street network and the development site.
In addition to the roadway improvements, the City currently owns and maintains a stormwater detention facility located immediately west of the Ven Park development. The existing detention facility presently functions as a dry detention pond and is designed to temporarily store and release stormwater runoff following rainfall events.
As part of the Development Agreement, the property owner has requested that the existing City-owned dry detention pond be modified and improved to function as a wet detention pond. Unlike the existing dry detention configuration, the proposed wet pond would be designed to maintain a permanent pool of water, subject to appropriate engineering, stormwater management, maintenance, and operational requirements.
Accordingly, the Development Agreement addresses the responsibilities and obligations associated with the proposed conversion of the existing City-owned detention facility from a dry pond to a wet pond, together with the roadway connectivity improvements involving West Madison Street and North Birch Avenue. The agreement is intended to clearly define the respective responsibilities of the City and the property owner regarding the design, construction, funding, implementation, and long-term operation and maintenance of these improvements, as applicable.
